ECOWAS court rules against Togo’s 2024 constitutional reform

The Togolese authorities have suffered a significant setback in the regional arena. The ECOWAS Court of Justice, following a petition from civil society groups and democratic organizations, ruled that the constitutional amendments enacted in March 2024 were implemented in violation of democratic principles and constitutional order.

This decision represents a serious blow to the Lomé government, which had sought to portray the reform as a process aligned with republican norms. Instead, the West African judges’ ruling undermines the legitimacy of a text that has been widely contested by opposition factions and civil society since its adoption.

The legal challenge was spearheaded by the Touche Pas À Ma Constitution coalition, supported by numerous citizen groups and democratic forces. Their petition aimed to challenge what they viewed as a constitutional alteration imposed without genuine public consultation, designed to further entrench the ruling power.

For the plaintiffs, the regional court’s decision validates their assertion that popular will was sidelined in favor of institutional overreach. They condemn what they describe as a political maneuver that disregards the democratic aspirations of the Togolese people, a population already grappling with a shrinking civic space and recurring governance disputes over recent years.

The ruling has reignited discussions on the country’s institutional trajectory. Civil society leaders are now calling for the suspension of the ongoing process and advocating for an inclusive political transition capable of restoring trust between institutions and citizens.

Beyond the legal implications, this case underscores the deep divisions within Togo and intensifies criticism of a political system that has been dominated by the same family for nearly six decades. Many observers argue that only a reform grounded in dialogue, adherence to the rule of law, and popular sovereignty can restore lasting stability and institutional credibility in the country.
